Terms Of Service

☽ - Commissions are currently OPEN - ☾

By purchasing a commission, you agree to my Terms of Service. Failure to do so will result in blacklisting, blocking, and further action if required.All prices and terms listed are subject to change and I reserve the right to alter them as I see fit.

Basic Rules + Process

✦ I will only work with those that are 18+.✦ I have the right to refuse service to anyone for my own comfort and safety.✦ I have the right to cancel a commission and issue a refund at any point if I decide I no longer wish to work with a client.✦ All commissions will be completed within a 1 month time frame at most. I will provide updates, sketches, and WIP's as I work but will not tolerate being pestered about progress during this time. If it has been more than the estimated time for completion, I will be happy to discuss further steps with you.✦ When commissioning me, you must provide clear references and information to avoid any confusion or unhappiness with the final product. It is your responsibility to ensure you communicate clearly with me as the artist. Blurry/low quality references will incur a complexity fee.✦ Upon the completion of your commission, I will provide the necessary files and I will be happy to email them if requested. There will be no physical products provided, I only work digitally.✦ I do not consent to having my art fed into any computer-generation programs such as AI.✦ I do not consent to my work being used without my consent in any way for the purposes of training AI models.✦ I do not consent to my art being used in NFT work under any circumstances.

Payment + Refunds

✦ I take all payments through Paypal or Kofi in USD currency. Please specify beforehand which method you'd like to use.✦ Payment is required in full up front unless otherwise discussed with me beforehand.✦ Refunds will only be available up to the lining phase. Furthermore, the amount you are refunded is dependant on how much is completed.  No progress on the commission = 100% Refund
  Sketch completed = 70% Refund
  Lines completed = 50% Refund
  Flats/shading completed = 0% RefundThis is to protect my integrity as an artist and the work I put into my art.
You may change which character you'd like drawn prior to me beginning the sketch and not after.✦ Complex designs, poses, scenes, or prompts will incur a complexity fee that varies depending on what you're asking for.✦ I am willing to make major changes to the sketch up to three times unless those changes are a mistake regarding the design on my part. Any further major changes will incur a fee.✦ After the lining stage, I will not accept major changes, only small ones such as hue changes or corrections on the design.✦ Any unauthorised chargeback of payment after the commission is started will result in blacklisting. If you have any issues or would like a refund, please communicate this with me beforehand and I will accommodate you as best I can.✦ If you fail to provide payment within 1 week of me accepting your commission, I will forfeit the slot and cancel the commission.

Copyright

I reserve the rights and ownership to all artwork I create, digital or otherwise.
This includes, but is not limited to, commission work, trades, and gifts.I have the right to display these pieces in my portfolio, on my website, and on my social media accounts.Should you wish your commission be kept anonymous or would like me to refrain from posting it for a certain period of time, please let me know ahead of time.You, as the client, have the right to post and upload your commissioned artwork that you have paid for in full.
This counts as personal / private use.
However, I do not allow commercial production of my work under any circumstance, including commissions.
This includes, but is not limited to, stickers for sale, merchandise, or prints. If you would like clarification on if your usage is personal or commercial, please contact me.You, as the client, must credit me as the artist when posting or uploading your commission anywhere.

Designs

✦ Upon the purchase of a design created by me, whether that be a custom or an adopt, all copyright and ownership TOS applies to the artwork and design.✦ When participating in a BTA auction on my toyhou.se please keep in mind that all payments are made through paypal in USD only.✦ Each bid must be in adherence with the listed starting bid, minimum increase, or autobuy.✦ If an adopt comes with extra art in an autobuy situation, the buyer must adhere to my commissions and general TOS when waiting for the additional piece(s).✦ Once a bid is accepted, payment must be sent within 24 hours of acceptance unless a hold is discussed beforehand.✦ I can provide a hold for up to 2 weeks on adopts and designs unless otherwise stated. Please make it clear that you need a hold when bidding on or claiming a design.✦ On a case by case basis, I can discuss holds longer than 2 weeks. Please make this clear before bidding on or claiming a design.✦ When reselling a design made by me, be it a custom or adopt, the new owner of the design must adhere to my TOS.✦ All my designs must remain on Toyhou.se where possible. This is non-negotiable.✦ When rehoming a design by me, you may not sell it for more than it is worth or was bought for.
For example, if you bought it for $20 and have not spent any more money on art of that character, it cannot be sold for more than $20. If you spent an extra $10 on art for that design, it can then be sold for $30.
This applies to any art added.✦ If you receive a design by me for free, you may not sell it for money. It must be given for free again.✦ You may make changes to my designs as the owner of it but I must remain credited as the creator and designer of the original.
